Guarantee of Quality:

The supplier is Midge Tech Ltd, trading as midgetech.co.uk, guarantees that all Mosquito Magnet® products meet the required standards for the purpose they were intended.

Payment Options:

Midge-Tech Ltd trading as www.midgetech.co.uk and hereafter referred to as www.midgetech.co.uk accepts VISA, MasterCard, Visa Debit, Switch, Solo, BACS, Bank transfer and Bankers Cheques. We are now able to accept your credit card details by e-mail over the Internet using a secure payment system, or you can place your order over the phone 07766774458, by fax 01877384760, or forward a cheque for the full amount. If you wish, we can contact you by telephone to collect your credit card details.

Returns Procedure:

www.midgetech.co.uk makes every effort to ensure orders arrive in perfect condition. However, in the unlikely event of an order not being delivered within 15 working days from the dispatch date (Saturdays, Sundays & United Kingdom Public Holidays not included) customers should advise www.midgetech.co.uk by e-mail - info@midgetech.co.uk, www.midgetech.co.uk will make every effort to locate the order, and if necessary, send a replacement at our expense or provide a full refund, subject to the correct delivery address having been supplied to us with the order. If an order arrives damaged in any way, customers should contact www.midgetech.co.uk by e-mail within 7 days of receipt. In this case www.midgetech.co.uk will, depending upon our customers' preference, arrange for the damaged product to be picked up and returned to our warehouse. www.midgetech.co.uk will either send a replacement product upon confirmation that the damaged product has been returned or make a refund. If you wish to cancel an order please cancel the order before the day of despatch. Under The Consumer Protection (Distance Selling) Regulations 2000, the consumer has a cooling-off period of 7 working days beginning on the day after the day on which the consumer receives the goods. A refund will be made within 30 days from the cancellation date, less the cost of the return if the goods are not returned by the consumer within this period.

It is the customer's own responsibility to ensure the goods safe keeping and retention of quality and if goods are returned that are not either faulty or wrongly despatched but simply returned as not required, then it is the customer's responsibility to arrange this at the customer's own expense.

www.midgetech.co.uk is entitled to levy a return charge to cover the administration and re-packaging of said items at a cost of 30% + VAT of the retail price.

Where goods become faulty within the manufacturer's period of guarantee, and the fault is not due to mishandling by the user, action will be taken to repair or replace the item in accordance with that manufacturers warranty. Goods to be returned after the 7 day period above or those that are not faulty, can only be done so with the agreement of www.midgetech.co.uk who reserve the right, in all cases, to make a re-stocking charge of 30% + VAT. This in no way affects your statutory rights

Refunds:

Refunds for valid claims will be made via the same method of payment as were used to place the order.

Delivery Methods & Times:

www.midgetech.co.uk offers delivery within 5 working days on all Stock items using two forms of courier for UK addresses after payment has been received. Personal cheques may take upto 5 working days to clear while credit or debit card payments take less than 24 hours. In the event of goods ordered by the customer not being available within 5 working days from payment, the supplier will advise the customer of such unavailability within that said period and will reimburse any sums paid by the customer unless the customer and supplier agree otherwise by communications by fax or e-mail.

All orders received before 2pm GMT between Monday and Friday (excluding Bank Holidays) where the item is in stock will be despatched either by Royal Mail or by Next Day Courier service after payment has been confirmed. Occasionally the suppliers carriers may, due to circumstances beyond their control, fail to honour the delivery requirements placed upon them and as such www.midgetech.co.uk can accept no liability for any problem or inconvenience this may cause. Destinations where next day delivery does not apply include; Isle Of Man, Northern Ireland, Channel Islands, Scottish Highlands & Islands, Isle Of Wight , Scilly Isles and the Republic of Ireland.

Retention of Title:

This remains with www.midgetech.co.uk until the goods are paid for in full.

VAT:

All our store prices are VAT inclusive. A VAT invoice will be forwarded to you with your delivery. When you enter the cashier section of the site you will be presented with an order confirmation that breaks down the gross amount into separate net and vat amounts. This is for the benefit of our VAT registered business clients to facilitate VAT claims.

Stock Levels:

Our shopping basket system is operated using an inventory with stock in hand. Confirmed orders indicate the item(s) ordered are in stock. If for any reason the stock levels show an item temporarily out of stock or insufficient quantity to meet the customers demands, please contact us by e-mail at info@midgetech.co.uk and we will advise the date that stock item will be available again.

Order Acknowledgements:

An order placed on the website will be construed as an offer to purchase from the customer to the supplier and will be acknowledged as received through an order acknowledgement sent to your e-mail address. Acceptance of payment by the supplier constitutes acceptance of the order by the supplier. If there are any problems with your order then you will be contacted directly. The price of the goods shown by the supplier will only remain valid until such times as it is periodically reviewed by the supplier in its own unlimited discretion, bad faith only excepted, or until payment has been received from the customer, or whichever is earlier.

Data Protection:

The information requested on this site may be used by www.midgetech.co.uk to confirm, update and enhance our customer records. Information may also be disclosed and used for fraud detection purposes. In terms of the Data Protection Act 1998 you are entitled to a copy of all your personal data held by us on computer on payment of a small fee.

LIMITED WARRANTY:

The Product manufacturer, American Biophysics Corp., having its principal place of business at 2240 South County Trail, East Greenwich, RI 02818 ("Manufacturer") warrants its Mosquito Magnet™ as follows:

  1. Limited Warranty. Manufacturer warrants that the Products sold hereunder will be free from defects in material and workmanship for a period of one (1) year from the date of purchase with proof of purchase. If the Products do not conform to this Limited Warranty during the warranty period (as herein above specified), Buyer shall notify Manufacturer in writing of the claimed defects and demonstrate to Manufacturer satisfaction that said defects are covered by this Limited Warranty. If the defects are properly reported to Manufacturer within the warranty period, and the defects are of such type and nature as to be covered by this warranty, Manufacturer shall, at its own expense, furnish, replacement Products or, at Manufacturer's option, replacement parts for the defective Products. Shipping and installation of the replacement Products or replacement parts shall be at Buyer's expense.
  2. Other Limits. THE FOREGOING IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. Manufacturer does not warrant against damages or defects arising out of improper or abnormal use of handling of the Products; against defects or damages arising from improper installation (where installation is by persons other than Manufacturer), against defects in products or components not manufactured by Manufacturer, or against damages resulting from such non-Manufacturer made products or components. Manufacturer passes on to Buyer the warranty it received (if any) from the maker thereof of such non-Manufacturer made products or components. This warranty also does not apply to Products upon which repairs have been effected or attempted by persons other than pursuant to written authorisation by Manufacturer.
  3. Exclusive Obligation. THIS WARRANTY IS EXCLUSIVE. The sole and exclusive obligation of Manufacturer shall be to repair or replace the defective Products in the manner and for the period provided above. Manufacturer shall not have any other obligation with respect to the Products or any part thereof, whether based on contract, tort, strict liability or otherwise. Under no circumstances, whether based on this Limited Warranty or otherwise, shall Manufacturer be liable for incidental, special, or consequential damages. The manufacturer reserves the right to replace defective products with re-manufactured components.
  4. Entire Obligation. This Limited Warranty states the entire obligation of Manufacturer with respect to the Products. If any part of this Limited Warranty is determined to be void or illegal, the remainder shall remain in full force and effect.

Unforeseen Circumstances:

While every effort will be made to meet shoppers demands, cancellations or variations may be necessary and delivery delays may occur as a result of Act of God, War, Strike, Lockout, Labour Dispute, Fire, Flood, Drought or other causes beyond the control of www.midge tech.com. In such circumstances www.midgetech.co.uk will not be liable to pay compensation.

Complaints Procedure:

If you have a complaint, please contact us immediately by e-mail to info@midgetech.co.uk. All complaints will be acknowledged normally within one working day. Any complaint will be dealt with fairly, effectively and confidentially. These complaints will normally be dealt within seven working days unless otherwise advised to the customer. These terms and conditions do not affect your consumer's statutory rights.

Law:

These terms and conditions shall be governed by and construed in accordance with Scottish Law and you hereby agree to be subject to the jurisdiction of the Courts of Scotland.
